Continental Automotive Romania SRL is making available CORY, a car pooling application. This App allows users to communicate and share their location and routes in order to synchronize each other and share their car rides towards and back from work. Continental Automotive Romania SRL processes your personal data in the context of your usage of CORY app and in compliance with the applicable legal regulations.

1. Scope

The personal data provided by you is collected, processed and used by Continental Automotive Romania SRL for the purpose of the contract execution, within the framework of your use of the online car pooling application CORY app. Insofar as this is necessary for the execution of the contract, the data may be passed on to the companies affiliated with Continental Automotive Romania SRL pursuant to sections 15 et seqq. of the German Stock Corporation Act as stipulated in the Binding Corporate Rules of Continental. If permitted and/or prescribed by law, the data may be evaluated for reporting purposes (e.g. statistics).

Your data will be collected, processed and used solely in compliance with the applicable data protection regulations (e.g. your consent).

In accordance with the statutory provisions, all your data is treated as strictly confidential. CORY app processes personal data concerning the user, such as: GPS location, home address, work address (including exact office building), contact details, car model, car color, car plate numbers, name and surname, e-mail address, phone number, car seats number. The data is processed in order for the app users to be able to use the app functionalities (e.g. see available drivers and itineraries, ride times, etc.). The home addresses of the users are represented on the map only with simple markers without any personal data that can reveal their identity.

2. Functioning of CORY app

2.1 Installation of Cory app

Usage of the CORY app requires the installation of this App and the user’s proper consent to the Terms of Use and the Data Protection Declaration.

2.2 Registration of Cory app

The use of the CORY app requires registration by stating the user name and password received from the CORY app’s administrator. The user is free to change his/her password later individually. Furthermore the user has to give his/her prior consent to the Terms of Use and the Data Protection Declaration. For the purpose of honest and fair dealing with each other, the user is requested to provide true information regarding work and home address, car model and car plate number.

2.3 Communication between App users

The app only allows the transfer of the personal data of the user, as well as his/her vehicle data, to Continental Automotive Romania SRL and to the other users of the app. This also applies to the messaging service, which alone enables the exchange of messages between the user and Continental Automotive Romania SRL.

3. Collection, Processing and Use of Data in the CORY app

Continental Automotive Romania SRL only stores personal data relating to users of its Cory app if consent for this has been provided. The only data that is stored relates to: GPS location, home address, work address (including exact office building), contact details, car model, car color, car plate numbers, name and surname, e-mail address, phone number. The data is processed in order for the app users to be able to use the app functionalities (e.g. see available drivers and itineraries, ride times, etc.). The home addresses of the users are represented on the map only with simple markers without any personal data that can reveal their identity. In addition, Continental Automotive Romania SRL also processes personal data concerning the date and time of the use of the app, the page visits, the used page functions, with the purpose of using this information to measure website activity, to produce statistics and to improve the services and the information provided via the app.

Personal user data is solely used to process inquiries within the context of the consent granted or in compliance with applicable data protection regulations. Based on the legal requirements, Continental has enforced global, uniform and internal Data Protection Rules (Binding Corporate Rules) regulating the protection of your personal data.

The following personal data will be collected when the App is used:

• First and last name
• E-mail address
• User-ID
• Password
• Car plate number
• Car model
• Car color
• Home address
• Work address (including exact office building)
• Contact details
• Phone number
• GPS location (foreground and background location)
• Car seats number
• Competition score (1 point = 1 transported person)

Continental Automotive Romania SRL stores the data provided for the service such as: first and last name, e-mail address, user-ID, password, car plate number, car model, car color, home address, work address (including exact office building), contact details, phone number, GPS location (foreground location is used to show the positions of the driver and the passengers on the map and background location is used to notify the passenger that the driver arrived at pickup point and to notify the driver / passenger that he/she arrived at the destination), car seats number, competitions core, only for the purpose of communicating personally with you. The data is stored and/or used solely for the purpose of processing your inquiry/concern/participation in the competition. Your data is erased once processing of your inquiry/concern has concluded, provided that this erasure does not conflict with any statutory duties to retain records.

Furthermore Continental Automotive Romania SRL uses the e-mail address of the user after its expressly consent to inform on updates on CORY app and for marketing purposes.

4. Information Rights of User

Please note that, as a data subject, pursuant to the EU General Data Protection Regulation (EU GDPR), you have the following rights in connection with the processing of your personal data:

5. Protection of stored data

The security measures are continually improved and adapted in accordance with the latest technology. Data provided that is unencrypted could potentially be viewed by third parties. For this reason, we would like to point out that, with regard to data transmission over the Internet (e.g., by e-mail), secure transfer cannot be guaranteed. Sensitive data should therefore either not be transmitted at all or only via a secure connection (SSL). If you access pages and files and are then asked to enter personal data, please note that the transmission of such data via the Internet may not be secure and that there is a risk that it may be viewed and manipulated by unauthorized persons.

6. Closing Provisions

Continental reserves the right to change or amend these Data Protection Declaration in the interests of the CORY app at any time with effect for the future, provided that such changes are not unreasonable for the User. This shall be the case in particular if the changes do not involve any substantial detriment to the User, e.g. with changes in contact information, the commencement of additional services or any similar matters.

In each case of intended change to these Data Protection Declaration Continental shall give reasonable notice to the User of at least 7 days prior to any change coming into force. Such notification shall take place via email to the email address provided by the User upon registration or via pop-up window in case a registration was not required.

The User has to give his consent to the changed Data Protection Declaration to continuing the use of CORY app by ticking the respective opt-in box of the pop-up window or trough renewed logging in.
